Remanufacturing guarantee for Savoir Beds Nº1 and Nº2
(Does not apply to Savoir Nº3 bed, Savoir Nº4 Bed or Savoir Nº5 bed)

Should you decide, within six weeks of delivery of your Savoy Bed Nº1 or Nº2, to inform Savoir Beds that you prefer a softer or firmer mattress, we will be delighted to re-make it to your specifications. Savoir Beds will carry out this work free of charge, with the exception of delivery, for which a charge will be made. Remanufacturing will be carried out as quickly as possible. However, it will depend on the workshops’ production schedule. Throughout the remanufacturing process (which generally lasts one month), Savoir Beds will provide a replacement mattress, whose characteristics may not be identical.

Please note that a new mattress requires a settling-in period: you must use it for at least four weeks before deciding to have it remade.

Terms and conditions

Unless specifically agreed otherwise by a director of Savoir Beds Limited (“the Company”), the order is governed by the following Terms and Conditions:

1. These Terms and Conditions, together with any special terms set forth herein, constitute the entire agreement between the Company and the Purchaser of any goods from the Company (referred to as the “Purchaser”). These Conditions shall prevail over any previous agreement or understanding, whether written, oral or implied, between the Company and the Buyer relating to the subject matter of the contract. These Conditions are final and exclude any other conditions placed at any time by the Buyer, unless such conditions are included herein. By placing an order for goods or services, the Purchaser is deemed to have accepted these Conditions.

2. Assignment: This contract is entered into intuitu personae; the Purchaser may not transfer it to a third party without the written consent of a director of the Company.

3. Deviation from Terms and Conditions: No deviation from these Terms and Conditions shall be binding on the Company unless accepted in writing by a director of the Company.

4. Prices:

(a) Regardless of any estimate, the contract price shall be that quoted on the date of receipt of the order, subject to change between the said date and the date of delivery, in accordance with the provisions referred to in sub-paragraph (b) below.

(b) The Company is entitled to increase the contract price to take account of any increase in cost occurring after the date of receipt of the order as a result of:

(i) any change in the Purchaser’s requirements;

(ii) any specific instructions from the Purchaser or any lack of instructions;

(iii) any interruption, delay or other cause beyond the Company’s control;

(iv) any increase in taxes or levies relating to the goods or services affecting the contract price in any way, including VAT.

5. Payment: Orders deliverable within four weeks or with a value of less than 700€ must be paid in full in a single instalment. A minimum deposit of 50% is required at the time of order placement for all deliveries over four weeks or over 700€. The balance of the order is due three weeks before the estimated delivery date. Delivery cannot be made until the remaining balance has been paid in full.

6. Delivery: the Company makes deliveries on weekdays. It will endeavour to meet the Buyer’s requirements as far as possible. No claim for loss or damage to goods in transit or for failure to deliver will be accepted unless the Buyer has notified the Company in writing of such loss, damage or failure within three days of delivery.

7. Installation of the bed in the Purchaser’s home: It is the Purchaser’s responsibility to ensure that the bed can be easily moved into the room of his choice.

8. Maintenance of the bed or accessories: The Company declines all responsibility in the event of damage caused by non-compliance with the Company’s bed maintenance instructions or any maintenance instructions for the accessories concerned.

9. Storage: All items must be delivered to the Purchaser within 28 days of the date of shipment in France. Beyond this period, the Company may provide for storage of the items, but storage charges, payable in advance, will be applied. These charges amount to €100/month. Any month started is due.

10. Suggestions: Any advice or suggestions given by the Company or its representatives are given in good faith. The Company does not warrant the suitability or safety of the goods for any particular purpose. Any implied warranties or conditions (statutory or otherwise) are expressly excluded, except to the extent required by law.

11. Cancellation or modification of Purchaser’s orders: no cancellation will be accepted for any purchase made in the store. In other cases, no cancellation will be accepted after 14 days. No cancellations will be accepted once production has begun. No claim by the Buyer in respect of goods supplied hereunder will be accepted by the Company if the goods have been sewn, decorated, treated or altered in any way for use by the Buyer or, in the event that the goods are not manufactured by the Company and have been ordered from another supplier. Any modification will incur a handling fee of 10% of the order value, with a minimum charge of 70€.

12. The Company’s liability to the Buyer in respect of the quality of the goods supplied under this agreement shall be limited to the amount invoiced for such goods. The Company shall not be liable for any consequential loss (direct or indirect), costs or damages of any kind arising out of or in connection with the supply of goods or services hereunder, or the use thereof or any action taken or omitted in connection with the goods.

13. Transfer of ownership and risk of goods: Risk in the goods shall pass to the Buyer upon delivery. Nevertheless, in all fairness, title shall remain with the Company until receipt of full payment for all goods and services included in the applicable orders or contracts.

14. Governing law: this contract and these Terms and Conditions shall be construed and governed in accordance with English law, and the parties hereto agree to submit to the jurisdiction of the courts of France.

15. General:

(a) Buyer agrees to compensate and procure compensation for all reasonable costs, charges and other expenses incurred by Company in connection with the enforcement of these Terms and Conditions, any of the clauses or any other provision.

(b) All clauses and headings included in these Terms and Conditions are provided for information purposes only and shall in no way affect the meaning or interpretation of this Agreement.
